We would like to share the comparison between invalidation trials and oppositions on status of utilization, average duration of the Appeal Board’s deliberations, and trends of the JPO’s decisions. We will also introduce some issues on recent judicial precedents, specifically, judgement on “restriction of the claims” among requirements of corrections in an invalidation trial and judgement on unexpected remarkable effect as ground to affirm Inventive Step.
