In JPO examinations, we encounter Office Actions that state “even though the present invention differs from the cited inventions, the difference is merely a matter of design which a skilled person could have appropriately made” without any supporting evidence more often than in U.S. and EP examinations.
This webinar introduces an organized framework for making arguments against such a rejection and includes some case studies and a statistical analysis of that reason for rejection.
